ART CRIES OUT ONLINE IRAQ WAR MEMORIAL COMPETITION OFFICIAL RULES PAYMENT OF ENTRY FEE REQUIRED. SPONSORED BY: ART CRIES OUT.COM 1. ELIGIBILITY: Must be 18 or older. Void in AZ, MD, ND, VT, where prohibited or restricted by law and in any jurisdiction where registration is required by law. Employees, officers or directors of Art Cries Out, its parent, subsidiaries, affiliates, or members of their immediate families or same households are not eligible.
2. TO ENTER: Between 9 a.m. 11/1/2007and 11:59:59 p.m. ET on 1/31/2007, go to www.artcriesout.com. Submit your original work,
design, concept or art object ("work") which expresses and records your understanding of the United States' military operations
in Iraq (i.e., the "Iraq War"); the objective of the memorial is to assist this and future generations in remembering, interpreting
and understanding the Iraq War. Complete the entry form and upload your work as an image file attachment. Before submitting work,
check the box indicating that you have read, fully understand and agree to these Official Rules and pay the non-refundable $15
entry fee using the PayPal service. NOTE: Payments will ONLY be accepted via PayPal. If the entry fee presents a financial or
other hardship for you, Art Cries Out, in its sole discretion, may (or may not) waive the entry fee for you.
3. PARAMETERS FOR SUBMISSION. Work may be a drawing, installation, painting, photograph, poster, sculpture, video, or "other" media. Work must be in .jpg format (800 pixels) and no larger than 2 MB. Work must be solely the original creation of entrant and must not violate the trademark, copyright, intellectual property, right of publicity, right of privacy or other rights of any third party. Work must not contain any libelous, slanderous or defamatory matter. A work may only list a single individual as the entrant. No corporate/organization/business/club entries will be accepted. Works that are inappropriate, offensive, otherwise unfit for publication or are not in full compliance with these Official Rules, as determined by the Sponsor and/or judges, in their sole discretion, will be disqualified without notification to entrant. 4. GRANT OF RIGHTS IN WORK. Entrant grants to Sponsor a non-exclusive, irrevocable, worldwide, royalty-free, non-transferable right to exhibit and display the work on www.artcriesout.com for a period of up to (50) years. Entrant further acknowledges that Sponsor, in its sole discretion, may or may not display his/her work. If work is displayed, Sponsor shall determine the form and content of attribution to entrant. Entrant further waives any so-called "moral rights" in work. Entrant acknowledges that (a) works may be displayed on the web site in any order, pattern or sequence of Sponsor's sole choosing and for a period of time of Sponsor's sole choosing; and (b) agrees that he/she shall not be entitled to any compensation for exercise of such right (except for the Grand Prize if his/her work is considered the best overall). Entrant also acknowledges that, due to technological limitations, the display of his/her work may not be of the same quality as the original. Personal information supplied by entrants will not be sold, rented, divulged or posted. 5. GRAND PRIZE (1): $1,000. All taxes on prize and expenses not specified herein are the sole responsibility of winner. 6. JUDGING/DETERMINATION OF WINNER: All eligible works will be evaluated by a jury of the artist members of Sponsor using the following judging criteria: (a) social, historic and human content; (b)depth of sensitivity; (c) relevance to theme; (d) artistic merit; (e) persuasiveness and overall strength/vibrancy of message. The jury will take into account the chosen media in evaluating works. In case of a tie, the winning work will be the one with the higher/highest score in "persuasiveness and overall strength/vibrancy of message". The judging will be completed by 1/31/2008 and the potential winner will be notified by mail or email. By participating, you agree to the decisions of the judges and Sponsor, which are final and binding. Potential winner must complete, sign and return an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release (and, perhaps, additional documentation relative to the Grant of Rights, as per Rule 3) within indicated time period or prize will be forfeited with an alternate winner being selected. Return of prize notification as undeliverable will also result in prize forfeiture. 7. LIMITATIONS OF LIABILITY. Sponsor assumes no responsibility for (a) any incomplete or inaccurate information, whether caused by web site users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Competition or by any technical or human error; (b) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of any web site and/or entries/works; and (c) any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of e-mail on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof, or for injury or damage to entrant's or to any person's computer related to or resulting from downloading materials from any web site or participating in the Competition. Sponsor is also not responsible for late, lost, illegible/garbled, incomplete, damaged or misdirected entries/works. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering (or attempting to tamper) with the operation of the Competition or web site. If, for any reason, Sponsor determines in its sole discretion that the Competition is not capable of running as originally planned (e.g., computer virus, tampering, fraud), Sponsor reserves the right at its sole discretion to terminate, modify or suspend the Competition and select the winner by having the jury evaluate all eligible entries/works received prior to (and/or after, if appropriate) the action taken by Sponsor or by some other means deemed by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Notice of such action will be posted on www.artcriesout.com. 8. RELEASE OF LIABILITY & PUBLICITY: All entrants release and agree to hold harmless Art Cries Out, its parent, affiliates, subsidiaries, entities involved in the development, production or implementation of the Competition, their respective officers, directors, shareholders, representatives, agents and employees from any and all liability in any way arising from participation in this Competition, and/or possession, receipt, acceptance or use/misuse of the prize.
